Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of utonez.ng (the "Site") and any purchase you make from Utonez Clothier ("we", "us", "our"), a Nigerian fashion brand based in Port Harcourt, Rivers State. By browsing the Site, placing an order, or using our bespoke styling service, you agree to be bound by these Terms.

Registered as Utonez Collections Ltd, No. 76 Stadium Road, Port Harcourt, Rivers State (RC1607024).

2. Products, Pricing & Availability

All prices are listed in Nigerian Naira (NGN) and are subject to change without prior notice. We make reasonable efforts to display accurate colours, materials, and sizing, but slight variations may occur, particularly for handmade or made-to-order pieces. Product availability is not guaranteed until an order is confirmed and payment is received.

3. Bespoke & Made-to-Order Styling Service

Some items are produced to order based on measurements, styling preferences, or fabric selections submitted through our bespoke styling request form. For bespoke orders:

• Production begins only after full payment and confirmation of specifications with the client.
• Lead times will be communicated at the time of order and may vary based on design complexity.
• Once production has started, bespoke orders generally cannot be cancelled or amended — see our Refund & Exchange Policy for details.
• Clients are solely responsible for the accuracy of measurements and details submitted.

4. Orders & Payment

We accept payment via our payment partner, Paystack (card, bank transfer via Paystack, and USSD), as well as direct bank transfer to our corporate account. An order is considered placed once you submit it on the Site, and confirmed once payment has been successfully verified.

For Paystack payments, confirmation is automatic. For direct bank transfers, please send your payment to the account details provided at checkout or by our team, and include your order number as the payment reference — your order will be confirmed once we have manually verified receipt of funds, which may take longer than card payments.

You will receive an initial order acknowledgement, followed by a full order confirmation (including applicable taxes) once payment clears. We reserve the right to cancel or decline any order, including where payment cannot be verified, stock is unavailable, or fraud is suspected.

5. Product Authenticity

Select Utonez Clothier pieces carry a unique QR code that allows customers to verify authenticity. This feature is provided as a value-add and does not itself create additional warranty obligations beyond those stated in these Terms.

6. Shipping & Delivery

We currently deliver to Lagos State, Abuja, and Port Harcourt.

Delivery fees are subject to prevailing courier rates and will be calculated and displayed on the order/checkout page before payment.

Standard orders are typically delivered within 7–14 business days. Delivery timelines for custom or bespoke orders may vary and will be communicated to the customer at the time of order confirmation.

Risk in the goods passes to the customer upon delivery to the address provided at checkout. It is the customer's responsibility to ensure that all delivery details provided are accurate and complete.

7. Returns, Exchanges & Refunds

All sales made on the Site are final. Returns, exchanges, and refunds are only available in limited circumstances set out in our Refund & Exchange Policy, available on the Site and incorporated into these Terms by reference.

8. Intellectual Property

All designs, photography, logos, and content on the Site are the property of Utonez Clothier and may not be reproduced, distributed, or used commercially without our prior written consent.

9. Accounts & Acceptable Use

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. You agree not to use the Site for any unlawful purpose or in a way that could damage, disable, or impair the Site.

10. Limitation of Liability

To the fullest extent permitted by Nigerian law, Utonez Clothier shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Site or your purchase of our products, save for liability that cannot be excluded by law.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Rivers State.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The "last updated" date below will reflect the most recent revision.
